About These Terms
These Terms of Use govern your access to and use of the Brand Protection Submission Portal and any associated tools or functionality (together, the “Platform”).
The Platform is made available to support Richemont’s brand protection activities, including the reporting, review, investigation and enforcement of suspected infringements of intellectual property rights and other unlawful online activities.
By accessing or using the Platform, you agree to comply with these Terms of Use.
Updates to These Terms
Richemont may update these Terms from time to time. Any updated version will be made available through the Platform and will take effect from the date of publication. Continued use of the Platform following publication of updated Terms constitutes acceptance of the revised Terms.
About the Platform
The Platform is operated and supported by Corsearch on behalf of Richemont.
The Platform is intended solely for authorised users, including Richemont personnel, approved brand representatives and authorised Corsearch personnel supporting Richemont’s brand protection activities.
Richemont may restrict, suspend or terminate access to the Platform at any time.
Privacy
Personal data submitted through or collected via the Platform is processed in accordance with the applicable Privacy Policy made available through the Platform.
Users should review the Privacy Policy carefully before submitting information through the Platform.
Permitted Use
You may use the Platform solely for legitimate business purposes related to the reporting, review and investigation of suspected infringements, counterfeit activity, fraud, misuse of intellectual property rights or other unlawful online activity.
You agree to use the Platform responsibly and in accordance with applicable laws and regulations.
User Submissions
The Platform allows users to submit reports, comments, URLs, screenshots, documents, images and other supporting materials.
By submitting information through the Platform, you confirm that:
- The information is submitted in good faith;
- The information is accurate to the best of your knowledge;
- You have the authority to provide the submitted materials;
- The information is relevant to the reporting of suspected infringement or unlawful activity;
- The submission does not knowingly contain false, misleading or unlawful information.
Users should avoid including personal data unless it is relevant and necessary for the purpose of the report.
Prohibited Activities
Users must not:
- Use the Platform for unlawful purposes;
- Knowingly submit false or misleading information;
- Upload malicious software, viruses or harmful code;
- Attempt to gain unauthorised access to systems, data or accounts;
- Interfere with or disrupt the operation of the Platform;
- Use the Platform for commercial purposes unrelated to Richemont’s brand protection activities;
- Impersonate another individual or organisation;
- Submit content that infringes the rights of third parties.
Intellectual Property
All intellectual property rights in the Platform, including software, functionality, content, trademarks, logos, graphics and materials made available through the Platform, remain the property of Richemont, Corsearch or their respective licensors.
Nothing in these Terms grants users any ownership rights in the Platform or its contents.
Users may not copy, reproduce, modify, distribute, reverse engineer or otherwise exploit any part of the Platform except as permitted by applicable law.
Confidentiality
Information available through the Platform may contain confidential business information, investigation materials and other sensitive information.
Users must maintain the confidentiality of information obtained through the Platform and may only use such information for legitimate Richemont brand protection purposes.
Users must not disclose information obtained through the Platform to unauthorised persons.
Availability
Richemont and Corsearch do not guarantee that the Platform will be available at all times or free from interruptions, errors or security vulnerabilities.
The Platform may be modified, suspended or discontinued at any time without notice.
Limitation of Liability
To the maximum extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis.
Neither Richemont nor Corsearch shall be liable for any indirect, incidental, consequential, special or punitive damages arising out of or relating to the use of, or inability to use, the Platform.
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
Suspension and Termination
Richemont may suspend, restrict or terminate access to the Platform at any time where it reasonably believes that:
- These Terms have been breached;
- Use of the Platform creates security, legal or operational risks;
- Continued access is no longer required for business purposes.
Termination of access does not affect any rights or obligations accrued before termination.
General Provisions
If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement relating to use of the Platform and supersede any prior understandings relating to the same subject matter.
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales unless otherwise required by applicable mandatory law.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
